Despite the order, a staff member served the resident a regular-diet meal in his room without any supervision. Plaintiff stuffed the food into his mouth, including a hamburger and a bread roll, and choked to death. A wrongful death suit was filed alleging that the nursing staff was negligent in providing Plaintiff a tray of regular-diet food in his room, in failing to monitor Plaintiff while he was eating, and in allowing Plaintiff to eat in his room instead of the dining room.
